At the heart of the dispute is Senate Bill 3019, which categorizes sports-based prediction contracts under the state’s sports wagering framework. Kalshi argues this mandate directly conflicts with the Commodity Exchange Act, asserting that the company cannot comply with state licensing without undermining federal requirements to maintain a uniform national market.

Beyond the regulatory clash, Kalshi highlights the practical burden of the legislation, which is set to take effect July 1. The company claims that implementing geo-blocking technology to exclude Illinois users would create unrecoverable costs, while submitting to the state’s licensing regime would impose redundant regulatory obligations and potential criminal liability. This case intensifies a broader jurisdictional battle between states and federal regulators over the classification of event contracts, a conflict legal analysts suggest may eventually reach the U.S. Supreme Court.

Simultaneously, Kalshi is navigating a period of aggressive growth. The firm is reportedly in talks to secure a $40 billion valuation, nearly doubling its standing from just two months ago. With sports-related contracts driving approximately 65% of its trading volume, the platform continues to expand its CFTC-regulated offerings, recently adding perpetual futures for Zcash, Near Protocol, and Shiba Inu.
