Judge Rejects DOJ Effort to Block Alaska Senate Election Certification

The administration had requested federal intervention in the race involving Republican Senator Dan Sullivan and Democratic candidate Mary Peltola, specifically targeting the presence of a second candidate named Daniel J. Sullivan on the ballot. The DOJ argued that if the incumbent senator lost by a narrow margin, the election should not be certified, alleging the retired teacher served as a "spoiler" to confuse voters. Judge Gleason rejected these claims, noting that the administration failed to explain how its proposed ballot segregation and law enforcement investigations could proceed without violating the constitutional right to a secret ballot.

Legal experts maintain that running as a spoiler is not illegal in the United States, regardless of who may have encouraged the candidacy. University of Kentucky law professor Joshua Douglas emphasized that the second candidate’s qualification is a matter of state law, not federal oversight. Despite the ruling, the Department of Justice filed an immediate appeal, signaling a continued effort to influence the outcome. Judge Gleason’s decision underscored that such federal interference directly conflicts with the Constitution’s mandate that states determine the time, place, and manner of their own elections.
