South Korea Sets November Deadline for Crypto Tax Guidelines

The upcoming regulations aim to clarify the tax treatment of staking, airdrops, hard forks, and decentralized finance, which have long lacked clear definitions. While the government remains committed to the 2027 start date, officials are currently coordinating with major domestic exchanges like Upbit and Bithumb to ensure reporting systems can track income accurately. Investors earning more than 2.5 million won annually will be subject to a 20% national tax plus a local surcharge, totaling 22%, with the first filings expected in May 2028.

Despite these preparations, political friction persists. Lawmakers have questioned the feasibility of monitoring private wallet transfers and overseas exchanges, leading to multiple legislative attempts to postpone or repeal the framework. Although the government has already delayed implementation three times since 2020, Finance Minister Lee Hyoung-il has yet to signal a shift from the current schedule. Authorities intend to leverage the OECD’s Crypto-Asset Reporting Framework to bridge data gaps, though the challenge of capturing decentralized transaction activity remains a significant hurdle for tax compliance.
