The dispute centers on whether Polymarket’s peer-to-peer trading model falls under the Dutch Gambling Act. While the regulator, known as the Ksa, maintains that the platform’s facilitation of bets on future events meets the legal definition of gambling, the company insists its model—which lacks a central bookmaker and allows traders to exit positions—mirrors financial markets. Polymarket contends that its oversight should fall to the Dutch Authority for the Financial Markets, suggesting that its event contracts align more closely with derivative products than traditional wagering.

This legal challenge follows the Ksa’s decision in June to reject an earlier administrative objection from Adventure One, the entity operating Polymarket. The regulator’s stance remains firm: the use of blockchain technology and peer-to-peer mechanisms does not exempt the platform from gambling laws, particularly given the reliance on anonymous cryptocurrency payments. Despite Polymarket’s implementation of IP-based blocks for Dutch users, the Ksa has upheld its enforcement order and the associated financial penalties. As the court case proceeds, Polymarket continues to face similar regulatory headwinds across Europe, including recent access restrictions in France, Spain, and the Czech Republic.
