GSN CEO calls for conduct-based rules on political memecoins

Kirkley contends that tokens tethered to public figures create a unique ethical hazard where an official’s authority and visibility can directly inflate the market value of a personal asset. He suggests that the core issue is not the speculative nature of the memecoin itself, but the potential for those entrusted with public power to derive private gain from the influence they wield. Rather than sweeping blockchain products into a single regulatory category, the executive advocates for a framework focused on disclosure, ownership, and control.

California’s new law, which takes effect in 2027, targets memecoins issued or promoted by public officials, marking a shift toward ethics-based oversight. Kirkley believes this approach provides a viable model for other jurisdictions, as it isolates political conflicts from the broader development of tokenized securities and payment infrastructure. He warns that failing to distinguish between an attention-driven memecoin and a functional financial instrument—like a tokenized Treasury or stablecoin—would be as misguided as regulating every internet-based product under the same set of rules. By centering policy on the conduct of the individual rather than the classification of the asset, he suggests policymakers can protect public integrity without stifling financial innovation.
