EU Regulators Weigh New Oversight for DeFi Lending Protocols

The EBA’s recommendations, currently under review by the European Commission, target the blurring lines between traditional crypto service providers and decentralized ecosystems. Regulators are considering a suite of measures, including mandatory suitability tests for users, strict leverage limits, and enhanced disclosure requirements for firms that act as gateways to DeFi lending. The proposal also flags the potential for a formal certification regime for protocols, particularly where centralized entities facilitate the connection.

Stablecoin integration remains a focal point of this scrutiny. Policymakers are exploring restrictions on borrowing and lending involving asset-referenced and e-money tokens that require authorization under MiCA. This push aligns with recent warnings from the European System of Central Banks, which cautioned that platforms might be structuring products to circumvent current yield-generation rules. While the EBA maintains that current issuer requirements are generally sound, it continues to push for a broader regulatory perimeter to ensure that lending, borrowing, and staking do not escape oversight through complex corporate structures or interface-based access. The Commission’s consultation process, which runs until September 30, will determine whether these recommendations evolve into formal legislative proposals.
