Senate Stalls CLARITY Act Amid Partisan Ethics Dispute

Senator Cynthia Lummis, a primary sponsor of the bill, attributed the failure to Democratic resistance fueled by opposition to President Donald Trump. Speaking at a CoinDesk policy event, Lummis expressed frustration, claiming that despite incorporating 126 bipartisan changes, the opposition chose to prioritize political optics over regulatory progress. The bill, which passed the House in 2025 with significant support, seeks to carve out regulatory boundaries between the SEC and the CFTC.

Democratic senators, including Angela Alsobrooks and Kirsten Gillibrand, rejected the characterization that their votes were merely a reaction to the president. They pointed to unresolved ethics provisions as the primary obstacle, specifically citing concerns over the financial interests of elected officials in the crypto sector. The recent disclosure of Trump’s significant income from family-linked crypto ventures intensified these demands for stricter conflict-of-interest safeguards.

Despite the setback, the legislative path remains technically open. Senator Thom Tillis, who voted against the cloture motion, immediately filed a motion to reconsider, preserving the possibility for leadership to revive the measure. House leaders, including French Hill, continue to advocate for a bipartisan resolution, warning that further delays in establishing a federal framework leave the industry operating in a state of legal uncertainty.
