Binance Maintains EU Presence via Regulatory Loopholes

The world’s largest crypto exchange has adopted a strategy of interpreting MiCA’s reverse solicitation clause to justify maintaining active accounts. This provision allows service provision only when customers independently approach an unlicensed firm without prior marketing. Simultaneously, the platform has channeled European trading activity through an Abu Dhabi-based entity, operating under a different regulatory framework while it seeks a new member state for its MiCA application.

This approach follows the withdrawal of its Greek licensing bid in June, a process reportedly hindered by behind-the-scenes intervention from European Central Bank President Christine Lagarde. Although the European Securities and Markets Authority has pressed the exchange for proof of a proper wind-down, Binance maintains that its operations remain compliant. Data from Kaiko suggests this strategy has been effective: the exchange’s global spot trading volume remains above 45%, and its euro-denominated trading share has seen no significant decline since the July deadline.
