The amended S-1 registration statement, filed Aug. 24, assigns XRP a 4.88% weighting within the fund, trading under the ticker BAGZ. While the document posits that Ripple may leverage escrowed assets to support liquidity in stablecoin and FX pairs upon achieving regulatory clarity, the statement remains an issuer disclosure rather than a verified company policy. Attorney Bill Morgan has publicly questioned the origin of these claims, noting that Ripple has not announced any such intention to alter its distribution patterns.

Technical constraints on the XRP Ledger prevent any early release of locked tokens. The protocol enforces time-based locks, meaning Ripple cannot bypass scheduled expiration dates. Historically, Ripple manages its monthly supply by re-escrowing a portion of released assets. While the company could technically choose to retain more of these funds instead of returning them to escrow, such a move would be a change in distribution tactics rather than an unlocking of existing time-locked assets. With the CLARITY Act still facing a lengthy legislative path, including a procedural cloture vote scheduled for Sept. 15, the practical implications of the Cryptex filing remain speculative until Ripple addresses the matter directly.
