Family Forced into Deportation After ICE Detains 5-Year-Old in Austin

The detention occurred as Martinez Nieto was driving his son to a youth soccer match. Following the arrest, the pair was transported 150 miles to the South Texas Family Residential Center in Dilley, a facility long criticized by rights groups and lawmakers for reports of medical neglect and poor living conditions. Federal authorities refused to release the child to his mother, who remains in Austin, despite her efforts to secure his custody.

Representative Greg Casar, who chairs the Congressional Progressive Caucus, characterized the incident as a calculated use of children as leverage within the federal deportation system. Legal counsel for the family, Kate Lincoln-Goldfinch, confirmed that the parents opted for voluntary departure to prevent Liam from entering the Office of Refugee Resettlement system. Under current policy, children classified as unaccompanied minors can face months or years in federal custody, a fate the family deemed too dangerous to risk. The case underscores a broader trend, as more than 20,000 children in federal custody have recently lost access to legal representation through the termination of government service contracts.
