Judge Vargas, appointed by President Biden, determined that the policy initiated by Secretary of State Marco Rubio in January undermined the congressional mandate that grants consular officers individual discretion over visa eligibility. By categorically rejecting applicants based solely on their nationality, the administration effectively bypassed the specific, detailed criteria established by law for assessing immigrants.
The policy sparked a legal challenge from two nonprofit organizations and 11 individuals, including families separated by the suspension and foreign nationals with pending employment-based petitions. Diana Konate of African Communities Together described the court’s decision as a tremendous victory for the rule of law, noting that the ban had caused immeasurable harm by keeping families apart. Anna Gallagher, executive director of the Catholic Legal Immigration Network, added that the ruling affirms the dignity of the individual by rejecting a system that treated applicants differently based on their country of origin rather than their unique circumstances.
