ABC contends that the show has operated under a bona fide news exemption for over 20 years, and that enforcing equal-time requirements would stifle essential political discourse.

This shift in strategy has drawn praise from press freedom advocates who previously criticized the network for its perceived timidity. Seth Stern of the Freedom of the Press Foundation commended the move, stating that news outlets must stop allowing officials to use manufactured pretexts to harass broadcasters. Similarly, Jessica J. González of Free Press noted that the network appears to have realized that yielding to administrative pressure only invites further demands. The conflict follows a period of high tension between the network and the FCC, with Chairman Brendan Carr frequently threatening to revoke licenses over unfavorable coverage.
