The proposed consultation aims to address the complexities of a nascent derivatives market where computing power functions as a critical industrial input. While the agency has not finalized its request, the scope of inquiry likely includes benchmark reliability, potential for market manipulation, and the technical definition of a standardized unit of compute. This process could influence the timeline for CME and its competitor, Intercontinental Exchange, both of which are developing products to help data centers and AI developers hedge the volatile costs of renting graphics processing units.

CME’s planned contracts rely on Silicon Data’s daily benchmarks, which attempt to aggregate fragmented pricing across various hardware and regions. Meanwhile, ICE is pursuing a different strategy by utilizing the Ornn Compute Price Index and the NativX COIL Index to track diverse GPU models and energy-normalized compute. Because these products remain subject to regulatory oversight, the October 5 launch date for CME stands as a target rather than a guaranteed start. The outcome of the CFTC’s review will determine whether these exchanges can proceed with self-certification or if they must navigate more rigorous, time-consuming approval requirements.
