SEC Chair Paul Atkins previously championed the framework, suggesting potential pathways including a startup exemption for firms raising up to $5 million, and a broader fundraising exemption capped at $75 million over 12 months. These figures remain illustrative rather than binding, as any eventual Commission vote would merely initiate a formal notice-and-comment period rather than codifying immediate requirements.

This administrative stall arrives as legislative efforts face their own hurdles. The Digital Asset Market Clarity Act, or CLARITY Act, is currently awaiting a Senate cloture motion set to ripen on September 15. While the SEC continues to develop its internal rulebook, Atkins has repeatedly noted that only Congress possesses the authority to provide a fully future-proofed market structure. For now, the SEC’s meeting page remains vacant of a new date, leaving market participants waiting for the agency to reset its calendar.
