Supreme Court Ethics Code Faces Backlash Over Lack of Enforcement

The code, which largely mirrors existing guidelines for lower court judges, asserts that the justices have historically adhered to such standards and that the document serves primarily to clarify that position. However, advocacy groups and lawmakers argue the lack of oversight renders the promise of integrity hollow. Jeff Hauser of the Revolving Door Project characterized the initiative as a "toothless PR stunt" designed to shield the court from scrutiny following reports that Justices Clarence Thomas and Samuel Alito accepted luxury travel from prominent donors.

Legislative efforts led by Sen. Sheldon Whitehouse (D-R.I.) continue to push for a binding, transparent process that would allow a panel of lower court judges to investigate complaints. While Senate Majority Leader Chuck Schumer (D-N.Y.) acknowledged the code as a potential first step, he joined legal experts like Trevor Potter in highlighting the "glaring omission" of any enforcement authority. As it stands, the court remains the only branch of government without an independent body to oversee its ethical conduct, leaving critics to warn that the new guidelines amount to little more than business as usual.
