Chair Paul Atkins has championed this initiative since March, advocating for specific safe harbors that would clarify when securities laws apply to token-based arrangements. While the meeting agenda remains focused on the "Regulation Crypto Assets" proposal presented by the Division of Corporation Finance, it does not yet detail specific fundraising caps or eligibility thresholds. If commissioners vote to move forward, the agency will publish the proposed rules for public comment, initiating a transition period rather than immediate enforcement of new standards.

This regulatory push operates alongside legislative efforts, including the Digital Asset Market Clarity Act (CLARITY), which faces a Senate cloture vote on September 15. Although Atkins has maintained that agency-led rulemaking can address urgent market needs, he has acknowledged that statutory changes remain necessary for a durable framework. The current SEC proposal is limited to offering regimes and does not encompass the broader market structure or broker-dealer responsibilities, which are slated for separate consideration later in the 2026 agenda.
