Senators weigh curbing CFTC powers over sports betting markets

During a Senate Indian Affairs Committee roundtable, Indian Gaming Association Vice Chairman Tehassi Hill urged lawmakers to amend the Clarity Act to prevent sports and casino-style wagering platforms from bypassing existing gaming regulations. Tribal groups contend that expanding federal authority threatens the Indian Gaming Regulatory Act and established state-level oversight mechanisms. Senator Tina Smith suggested that clarifying language could be attached to the Clarity Act or the upcoming Farm Bill to ensure federal commodities law does not preempt local gaming contracts.

The debate highlights a growing friction between Washington and state officials. While CFTC Chair Michael Selig maintains that the agency holds exclusive jurisdiction over event-based contracts, attorneys general from 44 states have formally challenged this interpretation. These officials argue the CFTC is overstepping its mandate by attempting to regulate areas historically managed by states. Despite this legal uncertainty, trading activity remains high; Kalshi and Polymarket processed a record $50.59 billion in volume during July. Senate Agriculture Committee Chair John Boozman expressed sympathy for the tribal position but cautioned against conflating complex crypto market legislation with the distinct regulatory challenges posed by sports prediction platforms.
