The regulatory landscape for digital assets remains in limbo as the full Senate has yet to address the merged CLARITY Act, despite committee-level approval. Atkins emphasized that while statutory law provides the most durable foundation for the industry, the SEC possesses the existing authority to address critical gaps in fundraising, custody, and tokenized securities. The agency has already integrated several crypto-focused initiatives into its 2026 regulatory agenda, covering proposals for broker-dealers and market structure.

However, administrative rulemaking carries inherent limitations. Unlike the legislative process, the SEC cannot independently grant the Commodity Futures Trading Commission statutory jurisdiction over digital commodity spot markets. Furthermore, agency-led rules remain susceptible to reversal by future administrations, a vulnerability that legislation would effectively eliminate. As political negotiations over stablecoin rewards and ethics provisions continue, the uncertainty has dampened market expectations, with Polymarket data recently reflecting a 27% probability for the bill's passage. For now, the SEC continues to provide technical assistance to lawmakers while simultaneously developing its own rule proposals under the Administrative Procedure Act.
