Legal experts, including Gussie Lord of Earthjustice, noted that while the existing law never blocked infrastructure projects, it provided a necessary seat at the table for Tribes to protect sacred sites. Preservationists contend that shifting decision-making power away from local communities effectively guts the protections meant to ensure that the nation’s diverse history remains intact amidst rapid development.
