Republicans hold 53 seats in the Senate, meaning the legislation requires at least seven Democratic votes to advance. Thune’s strategy aims to create a public record of support or opposition, putting pressure on undecided lawmakers ahead of the midterm election cycle. The bill, which passed the House in July 2025, has faced persistent resistance from a cohort of seven Democratic senators led by Angela Alsobrooks, who argue the current framework lacks sufficient consumer protections and safeguards against illicit finance.

To bridge the divide, Senator Cynthia Lummis introduced an updated version on July 22 that integrates proposals from the Senate Banking and Agriculture committees. This revision includes a temporary restriction on digital asset activity by senior federal officials, including the president and vice president, set to expire in 2029. While the National Fraternal Order of Police recently reversed its opposition after reviewing updated anti-money laundering and fraud-prevention language, key senators like Thom Tillis maintain that a comprehensive ethics agreement remains elusive.

Failure to secure a vote before the August 7 recess could signal a long-term stalling of the bill, leaving the crypto industry in a regulatory gray area. Without federal legislation to clarify jurisdiction between the SEC and the CFTC, the sector remains subject to administrative guidance that is more susceptible to reversal by future administrations. Currently, prediction markets reflect the growing skepticism, with Polymarket traders assigning the bill a 33% chance of becoming law in 2026.
