The Department of Homeland Security’s narrative that two men—Lorenzo Salgado Araujo in Texas and Johan Sebastián Guerrero in Maine—posed an immediate threat has been challenged by eyewitness accounts and video evidence. Legal experts emphasize that failure to comply does not inherently justify the use of lethal force, which the Supreme Court maintains must be reserved for situations of immediate danger.

Concerns over these tactics were underscored by a recently surfaced video from Schaumburg, Illinois. The footage shows a woman being boxed in by unmarked vehicles with no emergency lights or identifying markers. She described the terrifying experience of being unable to distinguish between law enforcement and potential kidnappers. This lack of transparency has led the FBI to issue bulletins urging agents to clearly identify themselves to avoid confusion, though there is little evidence these guidelines are being followed by ICE.

Instead, the current administration is actively challenging state-level efforts to restrict the use of masks by agents during operations. According to Hiroshi Motomura, a professor of immigration and citizenship law at UCLA, the agency’s own methods make cooperation difficult. By failing to establish a trustworthy identity, agents are creating environments where fear and confusion escalate into violence, directly contradicting Homan’s demand for simple, immediate compliance.
