The legal challenge, filed Tuesday, targets the Digital Asset Tax Act, which is slated to take effect on January 1, 2027. CEO Cody Carbone stated that the organization is not seeking special treatment, but rather parity, noting that the provision was added to the state’s $55.9 billion fiscal budget with minimal notice. The complaint argues that economically identical transactions should not face different tax burdens simply because they rely on decentralized ledgers rather than legacy financial systems.
Industry participants fear that if the law survives, it could open the door for states to levy similar technology-specific taxes on artificial intelligence or cloud-based payment networks. The Illinois measure, signed into law by Governor JB Pritzker in June, is projected to generate roughly $60 million in annual revenue. However, the mandate requires brokers to register with the Illinois Department of Revenue and collect the tax as a separate line item, creating significant compliance hurdles for firms operating both within and outside the state.
Prominent figures, including Commodity Futures Trading Commission Chair Michael Selig, have criticized the move, claiming it slams the brakes on technological progress while federal lawmakers are still debating a coherent national framework. As the 2027 deadline approaches, the lawsuit forces a judicial review of whether a state can legally distinguish between financial assets based solely on the technical methods used to record their ownership.
