Critics contend that the agency’s independence has been hollowed out since the Supreme Court granted the president broader authority to purge independent regulators. Last year, the administration ousted three Senate-confirmed Democratic commissioners, leaving the CPSC with only acting Chair Peter Feldman. The new nominations, if approved, would finalize a shift toward executive alignment. The groups warn this transition poses an acute risk, as the president maintains significant financial stakes in major retailers and manufacturers—including Amazon, Whirlpool, and his own branded lines—that fall under the commission's regulatory purview. They argue that without minority representation to provide oversight, the commission risks losing its ability to act as an impartial referee for public safety.
