The measure, introduced by Senators Cynthia Lummis and Ruben Gallego, asserts that Bankman-Fried should under no circumstances receive a commutation or pardon. While the resolution carries no legal power to restrict the president’s constitutional authority, it reflects a firm legislative stance on the integrity of the U.S. financial system. Lummis, a Wyoming Republican, argued that the defendant already had his day in court, while Gallego, an Arizona Democrat, insisted that the prison sentence must stand.

This legislative move arrives as Bankman-Fried continues to pursue formal pardon applications despite his legal avenues narrowing. A federal appeals court recently upheld his conviction, rejecting claims that his trial was compromised by restricted defense evidence. Prosecutors originally secured a conviction in November 2023, proving that Bankman-Fried misappropriated billions in customer funds to fuel political donations and speculative investments at Alameda Research.

The Senate’s urgency is driven by a recent history of executive actions within the industry. President Donald Trump previously granted clemency to Silk Road founder Ross Ulbricht and Binance founder Changpeng Zhao, raising concerns among lawmakers that Bankman-Fried might seek similar relief. Although the White House has previously indicated no plans to intervene, the Senate’s unanimous vote serves as a preemptive warning against any future shift in executive policy.
